Equipment Rentals:
Our plan may require the Renter/Client to pick up rented equipment from our facility or current Renter/Client location and run their own event. Client must provide their own insurance, and return said equipment by the next working day by 8:00 AM, or have it ready to be passed to the next customer picking it up from current renter/client location. BOUNCE OMAHA will provide training and/or training materials for all personnel supplied, but does not accept responsibility for the Renter/Client’s negligence or the negligence of personnel authorized by said Renter/Client. Renter/Client agrees to supply at least two personnel per item rented at all times during the event to run equipment rented. A list of personnel used by the Renter/Client is require by BOUNCE OMAHA. Renter/Client agrees to ensure all equipment is fully attended, by at least two personnel per item (certain items require more) at all times.
FULL PAYMENT IS DUE BY THE START OF THE EVENT
Event Cancellations
i. Cancellations due to inclement weather: BOUNCE OMAHA cannot be responsible for variations in weather or unexpected weather conditions/changes. BOUNCE OMAHA reserves the right to cancel an event should inclement weather become a safety issue. This is applicable for all outdoor events. Should this happen, deposits can be moved to another day, but ARE NONE refundable.
ii. Renter/Client Cancellations: Should the client choose to cancel their event more than 30 days prior to the event date, client remains liable for 50% of the contract price. Should cancellation occur between 30 days and day prior to event, the client is responsible for 75% of the contract price. Renter/Client is responsible for 100% of the contract price should they cancel day of event. If a replacement renter CAN be found within the cancellation window, no fees will be charged, and 100% deposit will be returned.
iii. Unavoidable Detention: BOUNCE OMAHA commits, upon a signed contract and deposit, to delivering (make available for pick up) equipment and/or services requested for your event. However, BOUNCE OMAHA cannot be responsible for proven detention by sickness, accidents, acts of God, stolen/damaged equipment, access problems, safety issues, or any legitimate conditions beyond BOUNCE OMAHA authorized representative’s control.
BOUNCE OMAHA is always willing to reschedule events, if necessary, according to equipment and staff availability. We are committed to being flexible with our clients, and on occasion may need some flexibility.
Equipment Damages and Loss
Renter/Client acknowledges receipt of equipment, and acknowledges responsibility for said equipment. Should damages or loss of equipment occur, Renter/Client agrees to replace or repair damaged or lost equipment. Renter/Client also agrees to hold harmless BOUNCE OMAHA from any and all liabilities for injury, theft, loss, connected with the transportation and use of said equipment. In case of rented, where equipment is picked up by Renter/Client from BOUNCE OMAHA facility and/or equipments current location, or delivered by BOUNCE OMAHA authorized staff member to the Renter/Client facility, the Renter/Client is responsible for all equipment and is responsible to ensure that all equipment and accessories are supplied. In addition, the Renter/Client agrees not to operate equipment rented from BOUNCE OMAHA if that equipment does not have all required accessories.
Renter/Client acknowledges that all equipment has been delivered and/or been made available for pick up in clean, good working order. Renter/Client agrees to accept full responsibility to ensure that ALL equipment is cleaned and in good working order after each use and before being placed in storage bins/containers/bags before returning equipment to BOUNCE OMAHA or before passing equipment on to the next Renter/Client.
Preparing For Your Event
i. Make sure power outlets are a minimum 15 amps/120 Volts, and within 100 feet of the item requiring power.
ii. Ensure dimensions of item (within safety parameters of 5 feet all around) will fit in space allocated.
iii. Ensure proper lighting is provided.
iv. Ensure all paperwork is filled out and signed. This is the Renter/Client’s responsibility.
v. Keep a copy of all paperwork.
vi. Provide all needed attendants.
Payment/Payment Deposit
A 50% Non-refundable although transferable deposit is required to hold your date. Final payment is due no later than one day prior to the event. You will have 3 months from original invoice date to transfer your non-refundable deposit and new date of rental must not exceed 3 months from original rental date.
Security Deposit
A $100-$250 security deposit may be added to your invoice. This deposit will be returned (within 2 weeks; check by mail) after the games are returned or passed for clean, good working order. Renters/Clients who return or pass on unclean equipment will forfeit their security deposit.
Acknowledgement of Risks, Assumption of Risks & Responsibility, and Release of Liability for Organizations and Individuals
Warning: There are significant elements of risk in any adventure, sports or activity associated with the indoor or outdoor use of Orbitron, obstacle course, team Olympic and group dynamic games and activities incidental thereto (“referred to herein as activity or game/s”) and use of Bungee Run, Bouncy, Boxing, Gladiator Joust, Bounce House, Moon Walk and other like events. Although we have taken reasonable steps to provide you with appropriate equipment and/or skilled staff and/or skilled training so that you can enjoy an activity for which you may not be skilled, this activity is not without risk. Certain risks can be eliminated without destroying the unique character of the activity. The same elements that contribute to the unique character of the activity can be causes of loss or damage to equipment, or cause accidental injury, illness, or in extreme cases, permanent trauma or death. For your safety, and that of other participants, we think it is important for you to know in advance what to expect and to be informed of the inherent risks. The responsibility to obtain this knowledge belongs to the individual or group representative.
Acknowledgement of Risks: I acknowledge that this following describes some, BUT NOT ALL, of those risks: 1) Wind shear, inclement weather, lightning, variances and extremes of wind, weather and temperature; 2) Could affect sense of balance, physical coordination, ability to operate equipment, swim and/or follow directions; 3) Travel, including travel to or from the activity; 4) The presence of insects and marine life forms; 5) Equipment failure or operator error; 6) heat or sun related injuries or illnesses including sunburn, sunstroke, or dehydration; 7) Fatigue, chill and/or dizziness which may diminish my/our reaction time and increase the risk of an accident; 8 Entering or exiting indoor or outdoor activities; 9) Being too close or not observing individual rules; 10) moving parts such as bungee cords or like accessories; 11) Participant misuse and/or abuse to game, program or equipment that may cause accident or injury. I am (we are) aware that these activities may entail risks of injury or death. I/we understand the description of these risks in not complete and that unknown or unanticipated risks may result in injury, illness, or death.
Express Assumption of Risk and Responsibility: I/we agree to assume responsibility for the risks identified herein and those risks not specifically identified. My/our participation in these activities is purely voluntary. No one is forcing me/us to participate. I verify that I am physically fit, not under the influence of alcohol or drugs at this time, and sufficiently qualified, trained and capable to participate in these activities. Therefore, I assume full responsibility for myself/organization I represent, including any minor children, for which I am responsible, for bodily injury, accidents, illness, death, loss of personal property, and expenses thereof as a result of any accident which may occur. I/we elect to participate in spite of the risks.
Covenant of good Faith: I/we recognize that BOUNCE OMAHA will operate under covenant of good faith and fair dealing, but you may find it necessary to terminate an activity due to forces of nature, medical necessities, or other problems; and/or refuse to terminate the participation of any person you judge to be incapable of meeting the rigors or requirements of participating in the activity. I accept your right to take such actions for the safety of myself and/or other participants.
Authorization: I/we hereby authorize any medical treatment deemed necessary in the event of any injury while participating in the activity. I/we either have appropriate insurance or, in its absence, agree to pay all costs of rescue and/or medical services as may be incurred on my/our (organization’s) behalf. I/we agree to any film or photographs of me/us as a participant becomes your property and may be used for promotional purposes.
Release: In consideration of services or property provided, I, for myself and any minor children for which I am parent, legal guardian, pastor/group leader or otherwise responsible, any heirs personal representatives or assigns, agree that BOUNCE OMAHA, it’s principals, directors, officers, agents, employees, contractors, volunteers, their insurers and each and every land owner, municipal government agency upon those property an activity is conducted and their insurers, if any, shall have no liability of any nature for any and all damage to my child and other persons or properties as a result of any acts, omissions or negligence of the “owner” or any other person (including my child) or entity and I hereby release and discharge owner and insurer, if any, for any such damage.
In engaging in business and or renting from Bounce Omaha I have read/understand the Acknowledgement of Risks, Assumption of Risks and Responsibility, and Release of Liability. I understand that by renting from BOUNCE OMAHA, I MAY BE/AM WAIVING LEGAL RIGHTS.
